This guide provides a practical framework for evaluating AI tools through a HIPAA compliance lens, written specifically for small practices that may not have a dedicated compliance officer or IT security team.

Why HIPAA Compliance Is Non-Negotiable for AI Tools

HIPAA's Privacy Rule and Security Rule apply to all protected health information, regardless of the technology used to process it. When you send patient data to an AI tool for analysis, coding assistance, or documentation support, that tool becomes part of your compliance surface.

The consequences of getting this wrong are concrete. 1. Business Associate Agreement (BAA)

A BAA is a legally binding contract that establishes the vendor's obligations for protecting PHI. It defines permitted uses and disclosures, requires the vendor to implement appropriate safeguards, mandates breach notification, and ensures the vendor will return or destroy PHI upon termination of the agreement.

What to look for: The vendor should proactively offer a BAA before you even ask. If you have to convince a vendor to sign one, that is a red flag. The BAA should be specific to the services being provided, not a generic template that does not address AI-specific data handling.

What to watch out for: Some vendors claim that because their AI processes data in a "de-identified" form, a BAA is not required. Be extremely cautious with this argument. HIPAA's de-identification standard under the Safe Harbor method requires removal of 18 specific identifiers, and many AI workflows require data elements like dates of service, diagnosis codes, and provider identifiers that make true de-identification impractical. If there is any reasonable basis to believe the data could identify a patient, it is PHI and a BAA is required.

2. Encryption Standards

HIPAA requires covered entities and business associates to implement technical safeguards that protect PHI in transit and at rest. For AI tools, this means:

Data in transit must be encrypted using TLS 1.2 or higher. This applies to every data transmission between your practice's systems and the AI platform, including API calls, file uploads, and webhook notifications. TLS 1.0 and 1.1 have known vulnerabilities and were officially deprecated by the IETF in 2021. Any vendor still supporting these older protocols is behind on security fundamentals.

Data at rest must be encrypted using AES-256 or an equivalent standard. This covers all PHI stored in the vendor's databases, file storage, backups, and logs. Ask specifically about backup encryption, as some vendors encrypt their primary databases but leave backups unprotected.

Key management is equally important. Who controls the encryption keys? Where are they stored? Are they rotated on a regular schedule? The gold standard is a dedicated key management service like AWS KMS or Azure Key Vault with automatic rotation, not keys hardcoded in application configuration.

3. Access Controls

The HIPAA Security Rule requires role-based access controls that limit PHI access to the minimum necessary for each user's job function. In an AI platform, this means several things.

User authentication should require strong passwords and support multi-factor authentication. MFA should not be optional or available only on premium tiers. It should be the default.

Role-based permissions should allow practice administrators to define who can see what. A billing specialist may need access to coding analysis but not clinical documentation. A practice manager may need access to financial reports but not individual patient records. The platform should support this granularity.

Session management should include automatic timeouts, secure token handling, and the ability to revoke access immediately when an employee leaves the practice.

4. Audit Logging

5. Data Handling and Retention

Data minimization. Does the tool collect only the PHI necessary for its function? An AI coding assistant does not need a patient's Social Security number or home address. If a tool is collecting data beyond what it needs, that increases risk without adding value.

Model training. This is a crucial question for AI specifically. Does the vendor use your practice's PHI to train or improve their AI models? If so, this must be disclosed in the BAA and you must consent to it. Many practices are uncomfortable with their patient data being used to train models that benefit the vendor's other customers. Look for vendors that explicitly commit to not using customer PHI for model training, or that use privacy-preserving techniques like federated learning or differential privacy.

Data retention and deletion. How long does the vendor retain your PHI after processing? Can you request deletion? What is the process for data return or destruction when you terminate the relationship? These should be clearly defined in both the BAA and the service agreement.

Red Flags That Should Stop You Cold

In evaluating dozens of AI healthcare vendors, certain patterns consistently indicate inadequate compliance posture. If you encounter any of these, proceed with extreme caution or walk away.

No BAA available. If a vendor that handles PHI does not offer a BAA, they either do not understand HIPAA or are choosing not to comply. Either way, you cannot use them.

Vague security documentation. Statements like "we take security seriously" or "we use industry-standard encryption" without specifics are meaningless. You need to know the exact encryption algorithms, key management practices, and infrastructure details.

SOC 2 certification absent. While not a HIPAA requirement, SOC 2 Type II certification is the industry standard for demonstrating that a technology vendor has implemented and maintained effective security controls. A healthcare AI vendor without SOC 2 is missing a basic credibility marker.

Consumer-grade AI under the hood. Some vendors wrap consumer AI services like general-purpose large language models in a healthcare interface without ensuring the underlying AI service is HIPAA compliant. Ask directly: what AI models and services does the platform use, and do you have BAAs in place with each of them?

No breach notification process. The vendor should be able to describe exactly what happens if a breach occurs, including timelines for notification, the information that will be provided, and their remediation process. If they cannot articulate this clearly, they have not planned for it.

Ten Questions to Ask Every AI Vendor

Before signing a contract with any AI tool that will handle PHI, ask these questions and require written answers.

  1. Will you sign a Business Associate Agreement before we begin using the platform?
  2. What encryption standards do you use for data in transit and at rest?
  3. Where is our data physically stored, and in what jurisdictions?
  4. Do you use our PHI to train your AI models?
  5. Who on your team has access to our PHI, and under what circumstances?
  6. How can we access our audit logs?
  7. What is your data retention policy, and can we request deletion?
  8. Do you hold SOC 2 Type II certification? Can we review the report?
  9. What happens if you experience a data breach affecting our PHI?
  10. What subprocessors handle our data, and do you have BAAs with each of them?

Any vendor that cannot provide clear, specific, written answers to all ten questions is not ready to handle your practice's PHI.
